Federal Minimum Wage

The current federal minimum wage is $7.25 per hour. It has not increased July 2009.

The federal minimum wage for tipped workers for employees who earn $30 or more per month in tips is $2.13 per hour.

This means that if you’re a waiter, bartender, or other service employee who receives tips, your employer is only required to pay you $2.13 per hour in wages.

However, the total amount you earn ($2.13/hour plus tips) must equal the federal minimum wage.


Federal Overtime Laws Protect You

There is a federal law known as the Fair Labor Standards Act. (FSLA)


If you meet the requirements of this law you must receive overtime pay for hours worked over 40 per workweek. 


Your employer must pay you at a rate not less than 1 1/2 times your regular pay for overtime pay.


What Employers Can and Cannot Make You Do


Your employer absolutely CANNOT make you clock out at 40 hours then force you to keep working in order to avoid paying you overtime pay.

Your employer CAN prevent you from working over 40 hours in a single workweek without prior approval.
