How To Win A Car Accident Case
In order to win a car accident case your lawyer has to prove the other driver was negligent. This means they failed to act as a reasonable person under the circumstances.
The ways to prove the other driver was negligent includes proving they failed to control the speed of their vehicle if they struck your vehicle from the rear. Proving they ran a red light, failed to yield the right-of-way, failed to drive in a single lane or caused a head-on crash. Many times if the police came to the scene they will make a crash report. In the crash report the officer will state their opinion as to what factors contributed to the accident and indicate what driver contributed to the crash. This is good evidence to use to prove the other driver was negligent.
Another way, is to take the statements of any eye-witnesses who saw the other driver breaking the rules of the road. Finally, a dash cam video capturing the crash would be very compelling evidence.
If the other driver was intoxicated at the time of the crash your lawyer can subpoena the blood alcohol tests from the District Attorney’s office or police department. This may enetitle you to recover punitive damages as well as your actual damages like medical bills, lost wages and pain & suffering.
What If The Other Driver Did Not Have Insurance
If the driver that caused the accident did not have liability insurance you may file a claim with your own insurance company if you have uninsured/underinsured motorist coverage. This is a special type of coverage that is usually included in a “full” coverage type policy. There are so many people driving in Houston that do not have insurance. Make sure your auto policy has UM/UIM coverage. If you don’t know call your insurance company and ask if you have this coverage on your auto policy.
How Much Time Do I have To File A Lawsuit For a Houston Car Accident?
Generally you have two years from the date of the accident to file a lawsuit. If the injury is to a child the statute of limitations for their own physical pain & mental anguish, physical impairment and physical disfigurement may be extend past the two year deadline. Always check with a local Houston car accident lawyer to get professional advice on your specific situation.
If we wait longer than two years your claim will most likely will be denied. This law is known as the statute of limitations. It is found in the Texas Civil Practices & Remedies Code Section 16.003. It read like this:
§ 16.003. TWO-YEAR LIMITATIONS PERIOD. (a) Except as provided by Sections 16.010, 16.0031, and 16.0045, a person must bring suit for personal injury, not later than two years after the day the cause of action accrues. (b) A person must bring suit not later than two years after the day the cause of action accrues in an action for injury resulting in death. The cause of action accrues on the death of the injured person.
How An Auto Insurance Policy Affects Your Personal Injury Claim
You hear people say Oh, I got full coverage. But what does that really mean? Most people have no idea because they are not in the legal or insurance business. Take a moment to look at your own car insurance policy. Let’s see if we can make some sense out of all that complicated language.
Liability Coverage. In Texas it is required to have liability coverage to drive. This is the part of your insurance policy that covers you in case you are at fault for an accident and hurt or kill another person. The minimum coverage you have to have is $30,000 per person and $60,000 per accident. This means the most your insurance company has to pay for any one personal injury claim is up to $30,000. If there are multiple people that are hurt the most your insurance company has to pay is $60,000 for all claims.
So, if you are in a car accident caused by the other driver’s negligence the amount of liability insurance they have may affect the amount of damages you can recover against the insurance company. If the other driver only has $30,000 in liability coverage and your damages are more than that then the only way you can seek to be repaid for your other damages is if you have underinsured motorist coverage. For example say the true value of your personal injury case is $50,000. You can demand the the original driver’s insurance company pay you the full $30,000 in liability limits then submit an underinsured motorist claim to your own insurance company and demand that they pay you the remaining $20,000 for your damages.
Uninsured/Underinsured Motorists Coverage:
- Uninsured Motorists Bodily Injury
Uninsured Motorists Bodily Injury (UMBI) covers you for all sums (up to your policy limits) if an accident occurs with an uninsured or hit-and-run motorist who is determined to be legally at fault.
- Underinsured Motorists Bodily Injury
Underinsured Motorist Bodily Injury covers you for all sums (up to your policy limits) if an accident occurs with a motorist who is underinsured (i.e., they carry bodily injury limits less than your UMBI limits and less than the amount of the injuries).
Collision Coverage. This covers damage to your own auto caused by its collision with another vehicle or object. If you cause an accident, collision coverage will pay to repair your vehicle, and is normally the most expensive part of an auto insurance policy. If you have an old vehicle you may consider dropping this coverage to save money. That’s IF you are a good driver.
Comprehensive Coverage. This covers damage to your vehicle caused by something other than a crash, like fire, theft, vandalism, and falling objects. This also comes with its own separate deductible.
This pays you and your passengers for medical and funeral expenses incurred in an auto accident, regardless of fault. It will also cover injuries sustained by you while you’re operating someone else’s car (with their permission), in addition to injuries you or your family members incur when you are pedestrians. The down side of medical payments in Texas are that if you are in a crash caused by the fault of another person and you collect money for medical bills from the other carrier, many times you have to pay back your own carrier if they gave you medical payments.
It is always better to get P.I.P. coverage instead of medical payments. Most times, you don’t have to repay your own insurance company for P.I.P. benefits
Personal Injury Protection (PIP)
Just like medical payments this pays for you and your passengers medical bills up to a limit. The standard limit if $2500 per person but some policies go as high as $25,000 per person. ates that have enacted mandatory or optional no-fault auto insurance laws. Personal Injury Protection (PIP) usually pays up to 80% of lost wages in addition to medical benefits.

How Do Insurance Companies Evaluate Your Car Accident Claim
There are a variety of ways insurance companies determine whether they will pay your claim and how much they will offer. These include the following
- Who does the police accident report say was at fault for the crash
- If there are eye witnesses who do they say was at fault for the crash
- What are the total amount of your medical bills and lost wages
- Will you need any medical care in the future and how much will that cost
- Was the other driver intoxicated
- How much property damage was done to the vehicles
- What kind of injury did you suffer. The greater the severity of the injury generally the greater settlement value
- How much liability insurance coverage did the other driver have at the time of the accident
- Who is your lawyer. Yes, insurance companies keep track of the lawyers that settle quickly and those who are not afraid to go to trial
